01 Introduction
Welcome to MotoroCars. This Privacy Policy explains how MotoroCars ("we," "us," or "our") collects, uses, discloses, and safeguards your information when you use the MotoroCars mobile application (the "App"), available on the Apple App Store, and our website at motorocars.app (the "Site").
MotoroCars also operates physical automotive service locations through motorocars.com. The MotoroCars App and the MotoroCars physical shop locations are separate and independently operated businesses. This Privacy Policy covers our digital platforms and services only (the App and the Site). The physical shop locations maintain their own privacy practices. By using the App or the Site, you agree to the collection and use of information in accordance with this policy.

02 Information We Collect
We collect information that you provide directly to us, as well as information generated through your use of the App. Below is a detailed breakdown of the categories of data we collect.

Moto AI Conversations
When you interact with Moto, our AI car expert, we collect and store your messages, questions, and any photos you share within the chat. This data is used to provide accurate responses, improve the AI's capabilities, and maintain your conversation history. Moto conversations may include descriptions of car problems, pricing questions, appointment requests, and diagnostic inquiries.
Appointment and Service Data
- Service appointments booked through the app (date, time, location, service type)
- Service estimates generated (parts, labor, total cost breakdowns)
- Coupons saved, applied, and redeemed
- Rewards points earned and redeemed
- Service reviews and ratings submitted
- Payment history for prepaid services (processed through secure third-party payment processors — we do not store full credit card numbers)
Notification and Communication Data
- Push notification preferences and interaction history
- Service reminder schedules and responses
- In-app notification engagement
- Language preference (English or Spanish)
Location Data
We collect your location data when you use the App to find nearby MotoroCars service locations or when checking in for service appointments. Location access is requested at the time of use and can be revoked through your device settings at any time. We do not track your location in the background.
Device and Usage Information
- Device type and model (e.g., iPhone 15)
- iOS version
- App version
- General usage patterns (screens visited, features used, session duration)
- Crash logs and performance data
- Bluetooth connection status (for OBD-II dongle pairing)
Apple Wallet Data
When you add your MotoroCars membership card to Apple Wallet, we generate and store your member ID, name, membership tier (Founding/Platinum/Member), and rank title in association with the pass. This data is embedded in the .pkpass file and synced through Apple's PassKit framework.
03 How We Use Your Information
We use the information we collect for the following purposes:
- Car health tracking — To power the App's vehicle health monitoring, diagnostic analysis, and health score features using OBD-II data and vehicle information.
- Service reminders — To send you maintenance reminders and push notifications about your vehicle's service needs.
- AI-powered advice — To provide personalized car advice through our AI assistant, Moto, based on your vehicle data and service history.
- Appointments & coupons — To process service appointments, apply coupons, and manage your interactions with our service centers.
- Membership cards — To create and manage Apple Wallet passes for your MotoroCars membership.
- Communications — To send you email updates about the App, new features, and service-related information.
- Text notifications — If you provide your phone number, to notify you about app launches, service updates, and promotional offers (with your consent).
- Early access — To manage lead capture and early access lists for new App features and services.
- Improving the App — To analyze usage patterns and improve the App's features, performance, and user experience.
04 Third-Party Services
We use a limited number of third-party services to operate the App and Site. Each provider has its own privacy policy governing their use of your data.

05 Data Sharing & Selling
We do not sell your personal data to anyone. We will never sell, rent, or trade your personal information to third parties for their marketing purposes.
We may share your information only in the following limited circumstances:
- Service providers — With the third-party services listed above, solely to operate the App and provide our services to you.
- Legal obligations — If required by law, regulation, legal process, or governmental request.
- Safety — To protect the rights, property, or safety of MotoroCars, our users, or the public.
- Business transfers — In connection with a merger, acquisition, or sale of assets, in which case your data would remain subject to this Privacy Policy.
06 Apple Wallet Passes
The MotoroCars App allows you to add a digital membership card to Apple Wallet. When you create a pass, we store your member ID and name to generate and manage the pass. The pass is stored locally on your device through Apple's Wallet framework.
You can remove the pass at any time from your Apple Wallet. Removing the pass does not delete your MotoroCars account or associated data.
07 Text Message Consent (TCPA)
If you provide your phone number during signup, you may receive text messages from MotoroCars regarding app launches, service updates, appointment reminders, and promotional offers.
By providing your phone number, you expressly consent to receive text messages from MotoroCars at the number provided. You understand that:
- Consent is not a condition of purchasing any goods or services.
- Message and data rates may apply depending on your wireless carrier and plan.
- Message frequency varies based on your interactions and service needs.
- You can opt out at any time by replying STOP to any text message you receive from us.
- You can get help by replying HELP to any text message or by contacting us at app@motorocars.com.
We will honor all opt-out requests promptly. After opting out, you will receive a confirmation message and no further texts unless you re-subscribe.
This consent is provided in accordance with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and applicable FCC regulations.
08 Cookies & Tracking
Our approach to cookies is minimal and privacy-respecting.
- No tracking cookies — We do not use cookies to track your activity across other websites.
- No third-party advertising cookies — We do not serve ads or use advertising tracking pixels.
- Essential cookies only — We may use essential, strictly necessary cookies to enable basic site functionality, such as maintaining session state.
The App itself does not use browser cookies. Standard iOS analytics data may be collected as described in the Device Information section above.
09 Data Retention & Deletion
We retain your personal information for as long as your account is active or as needed to provide you with our services. We may also retain data as necessary to comply with legal obligations, resolve disputes, and enforce our agreements.
Your Right to Delete
You have the right to request deletion of your personal data at any time. To request deletion of your account and associated data, contact us at app@motorocars.com with the subject line "Data Deletion Request."
Upon receiving a verified deletion request, we will:
- Delete your personal information from our active databases within 30 days.
- Remove your vehicle data, service history, and diagnostic records.
- Instruct our third-party service providers to delete your data from their systems.
- Confirm deletion via email once the process is complete.
Certain data may be retained if required by law or for legitimate business purposes (e.g., transaction records for tax compliance).
10 California Privacy Rights (CCPA)
If you are a California resident, the California Consumer Privacy Act (CCPA) grants you additional rights regarding your personal information.
Your Rights
- Right to know — You may request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the business purposes for collection, and the categories of third parties with whom we share your data.
- Right to delete — You may request deletion of your personal information, subject to certain exceptions.
- Right to opt out of sale — We do not sell personal information. However, you have the right to direct us not to sell your information in the future.
- Right to non-discrimination — We will not discriminate against you for exercising any of your CCPA rights. We will not deny you services, charge different prices, or provide a different quality of service.
How to Exercise Your Rights
To exercise any of these rights, contact us at app@motorocars.com with the subject line "CCPA Request." We will verify your identity before processing any request and respond within 45 days as required by law.
You may also designate an authorized agent to make a request on your behalf. The agent must provide proof of authorization.
Categories of Information Collected
In the preceding 12 months, we have collected the following categories of personal information as defined by the CCPA:
- Identifiers (name, email address, phone number)
- Internet or other electronic network activity (device information, app usage)
- Geolocation data (location for finding nearby shops)
- Other information (vehicle data, diagnostic data, service records)
10b Florida Privacy Rights
If you are a Florida resident, the Florida Digital Bill of Rights (FDBR), effective July 1, 2024, provides you with the following rights regarding your personal data:
- Right to confirm — You may confirm whether we are processing your personal data.
- Right to access — You may access the personal data we have collected about you.
- Right to correct — You may request correction of inaccuracies in your personal data.
- Right to delete — You may request deletion of your personal data.
- Right to obtain a copy — You may obtain a portable copy of your data in a readily usable format.
- Right to opt out — You may opt out of the processing of your personal data for targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects.
To exercise your rights, contact us at app@motorocars.com with the subject line "Florida Privacy Request." We will respond within 15 days of receipt and fulfill the request within 45 days.
Note: MotoroCars does not sell your personal data, does not engage in targeted advertising based on your data, and does not use profiling for decisions that produce legal or significant effects. We process data solely to provide our car health tracking and maintenance services.
10c CAN-SPAM Compliance
In compliance with the CAN-SPAM Act, we agree to the following:
- We will not use false or misleading subjects or email addresses.
- We will identify the message as an advertisement in some reasonable way.
- We will include our physical business address in our emails.
- We will monitor third-party email marketing services for compliance, if one is used.
- We will honor opt-out/unsubscribe requests within 10 business days.
- We will allow users to unsubscribe by using the link at the bottom of each email.
10d Vehicle Data and Right to Repair
MotoroCars accesses your vehicle's OBD-II diagnostic port using a standard Bluetooth OBD-II adapter. Under federal law (the Magnuson-Moss Warranty Act) and the aftermarket right-to-repair framework, vehicle owners have the right to access their own vehicle's diagnostic data.
- We only read data that your vehicle makes available through the standard OBD-II protocol.
- We do not modify, write to, or reprogram your vehicle's systems.
- Using MotoroCars does not void your vehicle's manufacturer warranty.
- All diagnostic data belongs to you, the vehicle owner, and can be deleted at any time.
11 Children's Privacy
The MotoroCars App is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe that your child has provided us with personal information, please contact us at app@motorocars.com and we will promptly delete such information from our records.
If we discover that we have inadvertently collected personal information from a child under 13, we will take immediate steps to delete that information.
12 Data Security
We implement reasonable administrative, technical, and physical security measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet or electronic storage is completely secure.
While we strive to protect your personal information, we cannot guarantee its absolute security. You are responsible for maintaining the confidentiality of your account credentials and for any activity under your account.
13 Intellectual Property
The MotoroCars App, including its technology, features, and functionality, is the proprietary property of MotoroCars. Certain aspects of the App's technology are the subject of a pending patent application filed with the United States Patent and Trademark Office (USPTO).

14 Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will:
- Update the "Last Updated" date at the top of this page.

We encourage you to review this Privacy Policy periodically. Your continued use of the App or Site after any changes constitutes your acceptance of the updated policy.
